DAY 494: Baqarah 282-283

  •  O believers! When you contract a loan for a fixed period of time, commit it to writing. Let the scribe maintain justice between the parties. The scribe should not refuse to write as Allah has taught them to write. They will write what the debtor dictates, bearing Allah in mind and not defrauding the debt. If the debtor is incompetent, weak, or unable to dictate, let their guardian dictate for them with justice. Call upon two of your men to witness. If two men cannot be found, then one man and two women of your choice will witness—so if one of the women forgets the other may remind her.1 The witnesses must not refuse when they are summoned. You must not be against writing ˹contracts˺ for a fixed period—whether the sum is small or great. This is more just ˹for you˺ in the sight of Allah, and more convenient to establish evidence and remove doubts. However, if you conduct an immediate transaction among yourselves, then there is no need for you to record it, but call upon witnesses when a deal is finalized. Let no harm come to the scribe or witnesses. If you do, then you have gravely exceeded ˹your limits˺. Be mindful of Allah, for Allah ˹is the One Who˺ teaches you. And Allah has ˹perfect˺ knowledge of all things. If you are on a journey and a scribe cannot be found, then a security can be taken. If you trust one another, then ˹there is no need for a security, but˺ the debtor should honour this trust ˹by repaying the debt˺—and let them fear Allah, their Lord. And do not conceal the testimony, for whoever conceals it, their hearts are indeed sinful. And Allah ˹fully˺ knows what you do.

    Verse 282 is the longest single verse in the Quran. It is a comprehensive guide to recording debts in writing when you engage in transactions involving future payment. It covers who should write, who should dictate, who should witness, and the importance of justice in all financial dealings. Then verse 283 addresses situations where you are traveling and cannot find a scribe — in that case, a pledge (rahn) — collateral — can be taken.

    These verses are about protecting rights and preventing disputes. They show that Islam is not just about spirituality — it is about building a just society where people's wealth and honor are protected.
    Memory fades. People forget. People change. The written word protects both parties. It is not a sign of distrust — it is a sign of responsibility.
    If you have a skill (writing, witnessing, mediating), you cannot refuse to help others establish justice. Withholding your skill when needed is a form of injustice.

    282 (opening)    Write down all debts with specified terms 
      Memory fails. Writing protects.
    282 (scribe)    Scribe writes with justice, cannot refuse    Skills are trusts — use them for justice.
    282 (dictation)    Debtor dictates, fearing Allah. Guardian dictates if debtor unable.    The one who owes speaks first. Honesty is commanded.
    282 (witnesses)    Two men, or one man + two women. Witnesses cannot refuse.    Multiple witnesses ensure accuracy. Witnessing is a duty.
    282 (exceptions)    Write even small debts. Immediate cash transaction no need to write — but take witnesses.    Small debts destroy relationships. Write them.
    282 (no harm)    Do not harm scribes or witnesses. That is disobedience.    Protecting justice means protecting those who serve it.
    283    On journey without scribe — take a pledge (collateral). But trust is better. Do not conceal testimony.    Collateral protects rights. Trust is better. Hiding testimony is a heart disease.

    When you contract a debt, write it down with a scribe who writes in justice, let the debtor dictate honestly, bring two witnesses (or one man and two women), write even small debts, do not harm scribes or witnesses; if traveling, take a pledge — but trust is better; and never conceal testimony, for concealing it makes the heart sinful.
